When considering a mediation parties should consider what approach will best suit them and try to find a mediator who exemplifies this approach.

There is a broad range of styles or approaches that mediators employ. For example, some mediators will ask broad questions and some will focus on what they believe a court will do. Some mediators create a calm atmosphere and others create a sense of urgency. Some ask what’s your bottom line at the outset while others ask what really matters to you.

Any mediator should be able to convey their “style” in either a telephone conversation or an interview prior to starting the mediation and finding a mediator who matches your expectations can be crucial to a successful mediation and achieving a settlement.
